MEMORANDUM DECISION AND ORDER. THE COURT HEREBY ORDERS The Clerk of the Court shall DISMISS Heritage Home Health, LLC, and Angela Young and Defendants in this case pursuant to the Parties' stipulation (Dkt. 58). Heritage Home Health's Motion (Dkt. 29) is DISMISSED as MOOT. In like manner, Morriss Motion for joinder re: causation (Dkt. 33) is DISMISSED as MOOT. Defendants Elizabeth Fehringer, Elizabeth Loosli, and Carole Jeffries are also dismissed from this case based upon Plaintiffs concession (Dkt. 40, at 18). Plaintiff Darce Bishop is DISMISSED for lack of standing. Morriss Motion for Summary Judgment (Dkt. 28) is GRANTED in PART and DENIED in PART as outlined above. The Motion is granted as to Plaintiffs' federal claim. The Motion is denied in that the Court will not exercise supplemental jurisdiction over Plaintiffs' remaining state law claims. Those claims are DISMISSED WITHOUT PREJUDICE. The State Defendants' Motion for Summary Judgment (Dkt. 30) is GRANTED. The parties Motions for Leave to File Excess Pages (Dkts. 39, 46) are GRANTED.
