Notes MEMORANDUM DECISION AND ORDER - IT IS ORDERED: Respondent's Motion for Partial Summary Dismissal (Dkt. 12) is GRANTED. Claims 4, 6, 7, and 9 are DISMISSED with prejudice. Petitioner's Request for an Evidentiary Hearing (Dkt. 17) is DENIED. Respondent shall file an answer to the remaining claims within 90 days after entry of this Order. The answer should also contain a brief setting forth the factual and legal basis of grounds for dismissal and/or denial of the remaining claim.
