Citation text line 29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) Lot 4 & 5: On August 3, 2021 and at times prior thereto; the controlling employer, Element Construction Corporation, did not have an effective system in place to correct hazards to which their subcontractors were exposed. These hazards include but may not be limited to fall hazards up to 25 feet from various scaffolds where guardrails or other means of fall protection were not used. b) Lot 6 & 7: On August 3, 2021 and at times prior thereto; the controlling employer, Element Construction Corporation, did not have an effective system in place to correct hazards to which their subcontractors were exposed. These hazards include but may not be limited to 21.5 foot fall hazard from balconies where guardrails were not installed. c) Lot 4 & 5, 6 & 7: On August 3, 2021 and at times prior thereto; the controlling employer, Element Construction Corporation, did not have an effective system in place to correct hazards to which their subcontractors were exposed. These hazards include but may not be limited to trip and fall hazards when using various interior stairways that did not have handrails installed. d) Lot 6 & 7: On August 3, 2021 and at times prior thereto; the controlling employer, Element Construction Corporation, did not have an effective system in place to correct hazards to which their subcontractors were exposed. These hazards include but may not be limited to trip and fall hazards between the main floor and garage where the step was 28 inches high and a ramp or stair was not used. e) Lot 4 & 5: On August 3, 2021 and at times prior thereto; the controlling employer, Element Construction Corporation, did not have an effective system in place to correct hazards to which their subcontractors were exposed. These hazards include but may not be limited to maintaining proper machine guarding on table saws used to cut finish woodwork.
