29 CFR 1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) a) Building 4, 4th and Olive, Idaho Falls, ID 83401: On or about March 15, 2022; the controlling employer, Roth Properties, Inc. did not have an effective system in place to correct hazards to which their subcontractors employees were exposed to. These hazards include but may not be limited to falls of approximately 20 feet while using an extension ladder that was not positioned three rungs above the eave to access the roof of a two story building. b) Building 6, 4th and Olive, Idaho Falls, ID 83404: on or about March 15, 2022; the controlling employer, Roth Properties, Inc. did not have an effective system in place to correct hazards to which their subcontractors employees were exposed to. These hazards include but may not be limited to fall hazards of approximately 10.7 feet while performing framing activities without fall protection. c) Building 4, 4th and Olive, Idaho Falls, ID 83401: On or about March 15, 2022; the controlling employer, Roth Properties, Inc. did not have an effective system in place to correct hazards to which their subcontractors employees were exposed to. These hazards include but may not be limited to fall hazards of approximately 9.3 feet while performing roofing activities on a 5:12 sloped roof without fall protection. Note - Abatement certification and documentation is required for this item. |

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Building 4, 4th and Olive, Idaho Falls, ID 83401: On or about March 15, 2022, as the controlling employer, Roth Properties, Inc. did not ensure that subcontractors employees were protected from fall hazards.
