In Jan.XX/XX/XXXX, I had a $ XXXX loan with XXXX XXXX XXXX as the Trustee for XXXX XXXX, with Mr.Cooper as the servicer.Mr.Cooper increased my mortgage from $ XXXX to $ XXXX in XXXX and I attempted two very long and unsuccessful attempts at a modification but both were denied because the underwriter incorrectly used the {$14000.00} payment as part of my DTI ratio. They also informed me that there are no more interest only loans, which I know to be false.
I know DOJ reached a settlement with XXXX XXXX and $ XXXX of the settlement was to provide relief to American Consumers and is expected to be primarily in the form of loan modifications and other assistance to homeowners. I certainly fit into that group.
I have paid over {>= $1,000,000} on this loan since XX/XX/XXXX but can not possibly afford $ XXXX. I am not sure why they would want to foreclose on me, which they are getting ready to do.

My father, XXXX XXXX , passed away XX/XX/XXXX ; at the time he had a mortgage with Nationstar Mortgage Company, Loan # XXXX in XXXX , Idaho. I contacted Nationstar on XX/XX/XXXX to let them know that he had died and that we were looking through documents, looking for a will, etc. On XX/XX/XXXX I contacted Nationstar again via phone to tell them that the estate was insolvent and that I was sending a letter of insolvency along with a copy of the death certificate. They refused to talk to me about the account specifically because I was not on the account, I said that was fine, I just needed an address to send the letter to. I mailed those documents out on XX/XX/XXXX with the statement : This is to notify you that the account holder, XXXX XXXX XXXX , is deceased. Enclosed is a copy of the certificate of death.
It has been determined by a lawyer that the estate in insolvent as the deceaseds assets are insufficient to pay the estate debts, taxes, and administrative expenses ; no probate action will be contemplated.
Please exercise your rights as you see fit, however I kindly request that you stop contacting the estate regarding this account as required by the Fair Debt Collection Practice Act. ( please see attached document ) I had been receiving my bills for my father 's mortgage at my personal home address since mid- XXXX and continued to receive them even after my request to stop. I sent another letter mid- XXXX reminding them that the estate was insolvent, that I had already sent documentation and to please stop harassing me with bills at my personal residence. They persisted and bills/statements/etc. come to my home address several times a month ... since XXXX I have been returning these items to sender marked, " Return to Sender, Recipient Deceased, Estate Insolvent '', and have done so for nearly a year.
On XX/XX/XXXX at XXXX on a Sunday evening I personally was served papers that Nationstar is suing ME for my dad 's mortgage. There was no money in my father 's " estate '' to even pay for funeral services, so I had to pay those out of my own pocket, and now Nationstar is forcing me to pay for an attorney out of my own pocket for a debt that is not even mine. I have notified Nationstar of my father 's estate insolvency as a courtesy, and have repeatedly asked Nationstar to stop contacting me personally for debt collection on this account and they have persistently harassed my home address for 18 months. No where on my father 's mortgage is my name listed ( I was a minor at the time of the home 's purchase ) and now my name is listed in the state 's repository as a civil defendant. Nationstar would n't even talk to me on the phone because I was not on the account, but they 're certainly willing to bombard my mailbox with bills, and SUE me for the debt. I would say that Nationstar has used abusive, unfair, and deceptive practices to try to collect a debt that is not my obligation to pay.

On XXXX2017 I contacted XXXX XXXX ; the new company name of Nationstar Mortgage. While Nationstar Mortgage, I accessed my online account and opted out of all marketing offers ( mail, email and calls ) from both Nationstar and their partners. They were very aggressive in their marketing efforts ( multiple calls requesting I return calls only to find out it was a sales call, priority deliveries of refinancing sales flyers which interrupted my work day at least weekly if not more often ), etc.
The onslaught restarted when XXXX XXXX replaced Nationstar. I again accessed my account through XXXX XXXX to reset my communication preferences only to find they do not offer that via their website. So I called and requested the marketing from XXXX XXXX and their marketing partners cease. I received a confirmation of my cease and desist request in a letter dated XXXX from XXXX XXXX stating that I would now not receive ANY communications ( sales or account management ) from their company ( ie - account problem emails, escrow payments, etc ) as I do not agree to receive their sales communications. I really do n't feel that if I refuse their marketing, I am refused communication regarding my account ( except the monthly bill ) and that was not my original request -

My mother 's reverse mortgage serviced by Champion Mortgage went into foreclosure for failure to pay taxes & homeowners insurance. When she finally told me what was happening I sent the loan servicer, Champion Mortgage, an authorization for me to access her account info ; it took them several days & multiple faxes for them to update the account & speak with me. After repeated calls I was only able to obtain a verbal quote of {$18000.00} to cure the default - Champion refused to provide written breakdown of costs, nor written confirmation that the amount would stop the sale. I confirmed several times with XXXX XXXX XXXX at Champion that {$18000.00} was correct & on XX/XX/XXXX I sent XXXX cashiers checks totaling {$18000.00} to their XXXX MI office as instructed ; I sent it via overnight XXXX & have XXXX delivery confirmation for XX/XX/XXXX. Since XX/XX/XXXX I have called nearly every day to confirm account is current & to request breakdown of what the {$18000.00} paid for. I have detailed notes of who I spoke with & when. XXXX reps, XXXX & XXXX, were very professional & really did try to help me within the confines of their company, but several reps were unbelievably rude, condescending & nasty : XXXX & XXXX in particular were incredibly unprofessional & rude ; XXXX hung up on me when I repeatedly requested a supervisor, the other would repeatedly put me on hold for extended periods of time ( over 10 minutes ). It has been over 2 weeks & Champion has my mother 's XXXX & are still proceeding with foreclosure. I spoke with the Trustee conducting the sale & they have not received notice to vacate the sale. I work in XXXX & understand the system & still, I ca n't get this account cleared up, or even obtain an accounting of the money. How can an elderly person with no industry experience hope to sort things out? I know that a reputable loan servicer has no difficulty providing a written statement nor applying a default cure payment ; I deal with many lenders at work & know what to expect. This is beyond the pale. They also gave me a false foreclosure date of XX/XX/XXXX to push me to send money quickly ; per the Trustee the actual sale date is XX/XX/XXXX. Remember-this is a reverse mortgage, specifically for the elderly - there is no way that my mother would not stand a chance of getting this account cleared up & stopping the sale. I need help to force them to acknowledge the cure funds, stop racking up trustee foreclosure fees & provide an accounting ... please help.

Nationstar Mortgage has a new website that requires you to enter your zip code and your full social security number in order to access your account. I have always made my payments online with no problem through their old website.
I called to complain, and offered to verify by phone, but they said they can not change the software. That is the requirement. They will take payments by phone, for a {$19.00} fee. You can also set up auto pay, once you get the forms, or mail in your payments. Both choices delay my payment.
I have no access to my account for information, including year end tax info, unless I am willing to share my social security number online for any and all hackers to see.
I do not understand how Nationstar can get away with this legally.

My husband and I are in the process of divorcing. Our children and I remain in the home that he and I have a mortgage on through Nationstar Mortgage. Due to the debt to value ratio being severely upside down my husband 's lawyer advised him to file bankruptcy on the home. He refused to speak with the mortgage company. They called me and I informed them of our current situation. I asked them if there were any options available for me to be able to take over the payments and full ownership of the home. They provided me with a few options and informed me that because my husband had stopped paying the mortgage for the past 2 months that if I wanted to have any chance of saving the home I had to make up those payments as well as make the current payments. I let them know that as a stay at home mom who was just starting back into the work force I was n't positive that I would be able to do that. The representative told me it was the only way and that I would have to make XXXX {$750.00} payments for the next two months or the phone calls would n't stop. I told him I was n't comfortable making the commitment at that time on the phone but would think about it and get back to him. He continued to pressure me into setting up the payments before I got off the phone. I refused XXXX more times and his pressure continued and so to get off the phone with him I agreed with the intent to call back and cancel the payments. I called back before the first payment was due at the end of XXXX and said I could not afford the payments and asked for them to be cancelled. The XXXX payment was not processed. To my surprise on XXXX XXXX a payment for {$780.00} was processed in my checking account. I immediately called the mortgage company and informed them that the payment should not be occurring and that they needed to stop it because I had requested it to be cancelled and I did n't have the funds in my account. They said they could n't because it had already processed. I called the branch of my XXXX account and asked them to stop it and they said they could n't either. I 've spent a great deal of my time on the phone with the mortgage company requesting that the payment be returned. XXXX representative promised that it would be, another told me it would n't because I was behind on the payments and another disconnected my call when I asked to speak with their supervisor. The original agreed amount was to be for XXXX {$750.00} payments, XXXX the end of XXXX and the XXXX the end of XXXX. The payment the end of XXXX exceeded the agreed amount by {$30.00}. I am displeased with the dishonesty and manner in which this has been handled and I would simply like the money returned to me. The money that has been used to cover the payment now is the child support payments that are made and the account is still overdrawn by {$220.00}.

Approximately XXXX, 2015 paperwork was filed with NationStar Mortgage for a loan modification. NationStar informed the modification was not received so the paperwork was sent again. Again it was apparently not received.
XXXX of 2015 I XXXX XXXX of XXXX XXXX was hired to sell the property prior to Foreclosure Auction. XXXX investors discussed an offer of {$100000.00}. An offer was then submitted and accepted for {$110000.00}. According to the original payoff information provided by NationStar that would cover the XXXX & XXXX mortgage. XXXX XXXX, 2015, current payoff information was obtained by XXXX XXXX as closing on the sale was set for XXXX XXXX, 2015. At this time it was discovered that there was not enough funds to cover the sale. A short sale process was initiated. Information was sent to NationStar a XXXX time and also uploaded through the " XXXX XXXX ''. This was approximately XXXX XXXX, 2015.
XXXX XXXX, 2015 Notice was given through XXXX that the short sale request on the first mortgage was denied and to continue working on the XXXX mortgage short sale. This has been an ongoing process.
Property is set for Foreclosure Auction XXXX XXXX, 2015 and NationStar is neglecting to proceed in completing the short sale request to complete the sale and remove the auction Status. This is email sent today by XXXX XXXX to Asset Manager, Supervisor and " ManagerNSProcessing '' through XXXX. " My client and I would like to know who to file a complaint with regarding these loans and the status. XXXX XXXX has sent in paperwork twice for a loan modification which NationStar told her were not in the system. XXXX XXXX I began the process of short sale on the property and we have been in constant communication since. XXXX XXXX is our XXXX XXXX, he is who I have been working with. Last week I asked about progress on the loan, XXXX XXXX stated he would send a request for the XXXX, it was not on file yet. I just got of the phone with Rep who says request was sent yesterday! My client spoke to someone this morning referring her to a XXXX XXXX and was informed we are handling the process incorrectly and I should have spoken to a manager and provided XXXX and much more. All of this has been provided through XXXX and much more. Foreclosure auction is set for XXXX XXXX for at {$75000.00}, we have an offer and buyers waiting to complete sale at {$110000.00}. ''

Nationstar Mortgage , LLC has recently taken over the serving of our mortgage. My husband has been making extra payments on the loan. As he soon as he began paying extra on our mortgage, Nationstar Mortgage , LLC started charging illegal and unjustified charges to account. Although we have paid in advance and above our monthly payments, Nationstar Mortgage is claiming we are in default. Among the unjustified charages, Nationstar Mortgage has charged us {$1600.00} in legal fees, a fee of {$19.00} ( unexplained ), and a property inspection fee of {$100.00}. Nationstar is claiming that we are in default and must pay {$2.00}, XXXX to cure the default. Actually we are current on our payments and have paid over {$200.00} extra in payments. But Nationstar will not credit our payments is and is making up fees. None of these fees are permitted per my mortgage documents. More importantly none of them are legitimate. I would like CFPB to criminally charge this group. I am not the only victim of this comapny.

Fell under financial hardship and needing a loan modification for our primary residence.
Nationstar reps are giving different answers, solutions and timelines with every call making it difficult to make an educated decision on our primary residence.
We are not receiving the documents Nationstar said they have sent and have to call and request them. Some of Nationstar requests have deadlines. Not having all the information to make a decision is difficult.
We fear that because of the equity we have in our property, that Nationstar is not willing to work with us and taking advantage so they may profit.
With the Nationstar modification we were approved for, they are moving our delinquent payments to the end of the loan but we do n't know if we pay interest again on those payments and Nationstar will not tell us what happens after the trial payment period of their modification.

My husband passed away in XXXX. He had a reversed mortgage on our house - I was not old enough at the time to be put on the mortgage. After he passed away I contacted the mortgage company and found out they had a new program called the " non-borrowing spouse '' program where, if I qualified, I could remain in the house. I did all the required paperwork, they kept asking for more all the time dragging it out. They have put a foreclosure on the house and I need that action stopped until this issue can be resolved. I called the mortgage company weekly to get an update and was always told it was in the review stage and that they needed additional information. I immediately faxed all required documents - they probably have XXXX or XXXX copies of everything. When I called them on XXXX/XXXX/15 XXXX told me that I had been denied because I had n't had everything to them within the 120 day requirement. At no time was I told that I had 120 days to get all of this done. Actually everything was to them within that time limit but they are the one 's that kept asking for more and more. They also said that I would have a letter from HUD stating that I was denied within 10 days and I have never received a letter from HUD stating this.

I have a mortgage with Nation Star XXXX XXXX XXXX XXXX loan is XXXX old it was a 90 % purchase. Its a very hot real estate market in XXXX XXXX XXXX ID. Did my research and know what my house is worth which would put me close 70 % XXXX easy to qualify no PMI. I pick a re-value from a realitor. She came did it value came back {$22000.00} under purchase price from over 2 years ago. They did not send Xome valuation assessment until I ask for it once I got it immediately saw problem she listed it as a 2 bedroom vs a 4 bedroom ( appraisal from purchase has it listed as a 4 bedroom recorded as a 4 bedroom in county records ) Called Nation star told them of the mistake they said she a trained professional and I was wrong. I argued made my point said I would have to send all info I had to nationstar with all my facts and they would review. Have not heard or gotten anything in the mail from them very frustrating.

I had a payment of {$53000.00} sent overnight to Nationstar Mortgage , LLC. THe addressed used was the address on the website to accept overnight payments. It was received by their mailroom at XXXX on XX/XX/XXXX. After more than two hours over the last two days they still have not been able to tell me anything about this payment other than to ask if my check had cleared my account. I tried to remind them that this was a cashier 's check not a personal check. Today the call began approximately XXXX and ended at XXXX. I repeatedly asked for a supervisor, was promised I would be connected " now '' numerous times over a 30 minute time period, to a XXXX XXXX ... I was transferred to hold music and finally a XXXX XXXX answered. She finally took me up on my oft repeated offer to send a copy of the cashiers check and XXXX waybill to help her research department. She said it could take 7 days. This payment was to reduce the loan balance below what the net proceeds are for the sale of this home. If this payment is not applied the sale of the home could be cancelled. The title company handling the sale is waiting to hear that the payment was applied but soon the time limit for completion of the required paperwork will expire. The sale is to close XX/XX/XXXX. She verified that she had received the email containing the payment information.

I had lost my job and I tried to file a modification on my mortgage and Nationstar Financial denied me. I had met the criteria but they continue to deny me. I have started a new job as well as my wife. I ask for a forebearence to pay what I am behind. They bought the loan from XXXX XXXX XXXX and I had issues with them as well. I want to save my home or I will be homeless. I am a XXXX veteran and tried to go through every assistance program possible and yet no one can or is not willing to help.

In XXXX XXXX our fresh start loan was sold to. Nationstar mortgage Plc.
We tried to make a payment each month but they did not have all the paperwork from XXXX. After a few months of this excuse my husband actually called XXXX they stated to him all paperwork had been forwarded. Finally my husband thought he was being scammed they stated they could not accept any phone credit card check by mail only XXXX XXXX. Even though they kept sending monthly statements to us. They decided to foreclose on our home, I requested a modification through MHA they sent out the paperwork I got it back to them. They used my overtime to calculate my acceptance so instead of us having a smaller monthly payment now it 's way more and they wanted escrow for taxes and insurance. Our first payment did include a down payment first month payment and escrow. Two days ago I received notice my homeowners insurance is being cancelled for non payment. I also included this with my contract a copy of the invoice. Tried to call my contact person to find out why? I was. It going to leave one more message. Pressed zero got on the phone with XXXX told her what was happening she agreed to get a team lead on with us he said it will be a couple more days until they have it figured out Really!! I do n't have that my house insurance will expire on XXXX/XXXX/XXXX. I was on hold for over twenty minutes I had to go lunch was over. The foreclosure is not closed yet as of XXXX/XXXX/XXXX. " They are not done processing my loan ''! I have heard a couple days for everything now they said my foreclosure was moved to XXXX XXXX XXXX. I have an attorney and I am willing to go to any length to make sure this does not continue for us or anyone else. Also when we first got approved it was 8 % then the contract comes they know they have me by the nose it 's adjustable every two years until it 's 10 %. Is n't there a truth in lending? Or am I just stressed out enough over all this! You bet I 'm stressed I have been dealing with this for two years now! Can or will someone help me? I need an injunction and someone there the person who owns this company needs some jail or prision time.

Please see our 3 previous complaints filed on this case, XXXX, XXXX, XXXX. After withdrawing from bankruptcy, we applied for a modification with Nationstar. We thought everything was worked out and that we could start making payments again. We left our home for the winter before Nationstar could get the modification paperwork to us. Even though the modification was not signed, we made payments as scheduled in XXXX, XXXX, XXXX, and XXXX of XXXX as well as XXXX of XXXX. When the paperwork finally reached us, we were in XXXX for the winter. We took the paperwork to a notary to sign it and have it notarized. The notary told us that he could not notarize it since the property was located in XXXX. We immediately called Nationstar and they told us that that was not a problem and that we could sign and notarize the paperwork when we returned to XXXX in the spring. In late XXXX XXXX Nationstar called us and told us that they would no longer accept our payments because the paperwork had not been signed and notarized. However, they kept the previous 5 payments we had made, a total of about {$5000.00}. As soon as we returned to XXXX, we contacted Nationstar in an effort to get the modification in place and resume payments. We have submitted the modification paperwork but have not heard back. Meanwhile a law firm, XXXX, sent us another modification application as well as a foreclosure notification. At this point, we are not even sure who we are to be dealing with. We assume that it is Nationstar. We expect to hear back from Nationstar within about 30 days on the modification. We need someone in your office to stick with us on this case until it is resolved. Every time we call Nationstar, which is often, we talk to a different person who has no idea what is going on in this case. If we could sit down in a room with a representative of Nationstar and an arbitrator we could solve this problem in 10 minutes. We want to keep our house but we are getting tired of fighting.
