MEMORANDUM DECISION AND ORDER. IT IS ORDERED that Defendants motion for summary judgment (Dkt. 34) is GRANTED in part and DENIED. The motion is GRANTED as to Plaintiffs Idaho State Deeds of Trust Act claim, and this claim is DISMISSED without prejudice. The motion is GRANTED as to Plaintiffs claim under 24 C.F.R. § 201.50(b), and this claim is DISMISSED with prejudice. The motion is DENIED as to Plaintiffs Real Estate Settlement Procedure Act (RESPA) claim.
