Citation text line 29 CFR 1926.501(b)(13): 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Third floor balcony, front of building: On October 16, 2012 an employee walked from their work area inside the building to an extension ladder at the end of the balcony. A fall protection system was not in place on the open side of the balcony. A Hundred Percenters, Inc. was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 110131, citation 1, item 1, and was affirmed as a final order on March 16, 2012, with respect to a workplace located at South 5th West and West 5th South, Rexburg ID, 83440.
