OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from improper ladder use: (a) Shipping and receiving; On or about November 15, 2012, and at times prior thereto, employees working on top of the Produce Walk-in Cooler and other freezers were using step ladder(s) that were folded up and not fully extended. The step ladder observed was 12 feet tall and used to access the walking working surface on top of the Produce Walk-in cooler and exposed to falls to the concrete below of up to approximately 9 feet. Note: Abatement certification required for this item. |

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent): (a) Shipping and receiving area; On or about November 15, 2012, and at times prior thereto, employees working on top of the Produce Walk-in Cooler and other freezers were exposed to falls to the concrete below of up to approximately 9 feet. (b) Shipping and receiving area; On or about November 15, 2012, and at times prior thereto, employees working on top of storage racks were exposed to falls to the concrete below of up to approximately 8 feet. (c) Shipping and receiving, loading docks; On or about November 15, 2012, and at times prior thereto, employees working near docks were exposed to falls of up to 50 inches without fall protection or administrative procedures to prevent falls.
