29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: a) Jobsite: On July 27, 2017 and at times prior thereto the controlling employer, Rattler Construction, LLC, did not ensure that their employees were protected and that the sub-contractor(s) protected its employees from tripping and puncture hazards. 29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design: a) Jobsite: On July 27, 2017 and at times prior thereto the controlling employer Rattler Construction, LLC did not ensure that its sub-contractor protected their employees while using a scaffold system that was not designed and constructed by a qualified person. A guardrail system or other fall protection system was not in place on the scaffold. The sub-contractors employees were exposed falls hazards ranging from 14 feet to the lower level and 24 feet to the ground below. b) Jobsite: On July 27, 2017 and at times prior thereto the controlling employer Rattler Construction, LLC did not ensure that its sub-contractor had a qualified person design and construct a scaffold system that was used by their employees. A rough terrain forklift was used as part of the scaffold system to support a platform. The forklift manufacturer, Genie, warned of a personal injury hazard, prohibiting people from riding on the machine, other than at the operators' station, and no passengers are permitted to ride on machine or any attachment. The sub-contractors employees were exposed falls hazards ranging from 14 feet to the lower level and 24 feet to the ground below. The sub-contractors employees performing framing activities used a scaffold platform on a rough terrain forklift for access to their 3rd floor work area. A guardrail system or other fall protection system was not in place on the scaffold platform. The sub-contractors employees were exposed to a 24.4 foot fall hazard to the ground below. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) Jobsite: On July 27, 2017 and at times prior thereto the controlling employer Rattler Construction, LLC did not ensure that their sub-contractor protected its employees who performed framing activities on the 2nd floor balconies. Guardrail systems or other fall protection were not in place around the open sides of the balconies. This exposed the sub-contractors employees to 10.6 foot falls to the ground below. c) Jobsite: On July 27, 2017 and at times prior thereto the controlling employer Rattler Construction, LLC did not ensure that their sub-contractor protected their employees from fall hazards. The sub-contractors employees performed framing activities on the 2nd and 3rd floors. Guardrail systems or other fall protection was not in place on window openings.
