29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) On or about August 31, 2015, and at times prior thereto, Stock Construction Management, as the controlling employer, did not ensure that a competent person made frequent inspections of the jobsite to identify and correct hazardous conditions to which its workers and subcontractor workers are exposed. The framing subcontractor was on its second day of sheathing the roof and this employer had not conducted an inspection to identify hazards including the lack of fall protection, extension ladder deficiencies, and impalement hazards from protruding bolts. 29 CFR 1926.501(b)(2)(i): Each employee who is constructing a leading edge 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. a) On or about August 31, 2015, and at times prior thereto, two workers of the framing subcontractor installing wood sheathing on a nearly flat roof were not protected from fall hazards. The lower level of the roof was 14 to 15 feet high and the upper level was 17 to 18 feet high to the ground, concrete, equipment and materials below. Note 1: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. Note 2: Abatement verification is NOT required for this item. Corrected during the inspection. |

This ladder as used by workers involved in wood sheathing the roof. Note: Abatement certification is NOT required for this item. The ladders were observed corrected during the inspection. |
