29 CFR 1926.95(d)(1):Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees. (a) On November 24, 2020; the employer does not provide head protection at no cost to employees performing framing activities. Employees are exposed to head injuries from impact, flying objects, or from falling objects while underneath overhead work. Employees purchase their own head protection. (b) On November 24,2020; the employer does not provide eye protection at no cost to employees performing framing activities. Employees are exposed to eye injuries while using equipment such as, but not limited to pneumatic nail guns and claw hammers. Employees purchase their own eye protection. NOTE: Abatement certification is required for this item. |

29 CFR 1926.502(d)(6)(i): When a snaphook is not a locking type and not designed for the following connections, snaphooks were engaged directly to webbing, rope or wire rope: a) North/south side of roof: On or about April 27, 2017 and at times prior thereto an employee performing framing activities improperly used components of a fall protection system. A lanyard and snaphook were wrapped around a wooden truss and then hooked directly back on to the rope lanyard. This was used as the anchor point for the employee's personal fall protection. b) North/south side of roof: On or about April 27, 2017 and at times prior an employee performing framing activities improperly used components of a fall protection system. A snaphook and retractable cloth lanyard were wrapped around a wooden truss and then hooked directly back on to the cloth lanyard. This was used as the anchor point for the employee's personal fall protection. Note) Certification and documentation of corrective action ARE required for this item. |

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used: a) Jobsite: On or about April 27, 2017 and at times prior thereto employees performing framing activities did not recognize the hazard of working on a flat roof deck without a guardrail system in place. The employees did not take any action to minimize or eliminate the hazard. b) Jobsite: On or about April 27, 2017 and at times prior thereto employees performing framing activities did not recognize the improper use of components as part of their fall protection system. Snaphooks attached directly to shock absorbing rope lanyards were used as anchor points. The employees did not take any action to correct the hazard. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: a) Jobsite: On April 27, 2017 and at times prior thereto employees performed sheathing activities on a 10 in 12 pitched roof without a fall protection system in place. Employees were exposed to a 22 foot fall hazard from eave to ground. b) Jobsite: On April 27, 2017 and at times prior thereto employees performed framing activities on a flat roof deck. A guardrail or other fall protection system was not in place. Employees were exposed to a 16 foot fall hazard from the roof deck to the concrete and ground below. c) Jobsite: On April 27, 2017 and at times prior thereto employees performed framing activities on the second floor near window openings. A guardrail across the opening or another fall protection system was not in place. Employees were exposed to a 16 foot fall hazard to the ground below. Note) Certification and documentation are required for this item. Falcon Framers, LLC was previously cited for a violation of this occupational safety standard, 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 962580, citation number 1, item number 1, and was affirmed as a final order on May 30, 2014, with respect to a workplace located at 963 West Laughton Drive, Meridian, ID 83642. |
