29 CFR 1910.28(b)(14)(i): The employer did not protect each employee on the unprotected working side of a slaughtering facility platform that was 4 feet or more above a lower level from falling: a) Kill floor, flanker station: On April 13, 2021 and at times prior thereto fall protection was not enforced to ensure use for the employee(s) working at the flanker station. This work station platform is also used to elevate other employees as needed, to their work stations on the high bench. The employees were exposed to a fall hazard to the floor below, that changes from 4 and a half feet to 8 and a half feet. b) Kill floor, splitter station: On April 13, 2021 and at times prior thereto fall protection was not enforced to ensure use for the employee working at the splitter station. This work station moves up and down as needed for the work activity. The employee was exposed to a 5 foot fall hazard to the floor below. c) Kill floor, legger station: On April 13, 2021 and at times prior thereto appropriate fall protection was not enforced to ensure use for an employee working on the high bench platform, potentially exposing the employee to a 8 and a half foot fall hazard to the floor below. d) Kill floor, final trim station: On April 13, 2021 and at times prior thereto a proper fall protection system was not in place to protect an employee from falling off of the working side of the final trim platform. The employee was exposed to a 6 foot fall hazard to the floor below. Note) Certification of corrective action is required for this item. |

29 CFR 1910.30(a)(2): The employer did not ensure that each employee had been trained by a qualified person: a) Kill floor, high bench: On April 13, 2021 and at times prior thereto an employee performed legger activities on the working side of the high bench. The employee used a rolled up cargo strap wire tied to a rolled up lanyard as part of a personal fall restraint system. The employee did not recognize or acknowledge the hazard of using improper components as part of a personal fall restraint system, or take the necessary action to correct the hazard. b) Kill floor, high bench: On April 13, 2021 and at times prior thereto an employee performed legger activities on the working side of the high bench. The employee used a body belt with a 6 foot shock absorbing lanyard attached to a 3 foot overhead cable. The employee did not recognize or acknowledge the hazard of using improper components as part of a personal fall restraint system, or take action to correct the hazard. c) Kill floor: April 13, 2021 and at times prior thereto an employees worked at various elevated, processing stations without a proper fall protection system in place. These include but may not be limited to the flanker station, splitter station and final trim station. The employee(s) did not recognize or acknowledge the hazard of not having fall protection (proper guardrail or restraint) at the work station, or take action to correct the hazard.
