Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a the hazard of being being thrown outside the protective cage in the event of overturn. (a) Dick's Sporting Goods, Pocatello, ID: On or about March 9, 2011, and at times prior thereto, the employer did not instruct and/or enforce the utilization of the seat belts by operator(s) of the forklift(s).
