Citation text line HAZARD: STRUCK BY Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were surveying in the center of the Fairview and Mitchell Avenue's intersection and were exposed to the hazard of being struck by vehicles at this high traffic volume location. a) Fairview and Mitchell Road, middle of intersection; On or about June 5, 2011 and at times prior thereto, employees locating a survey monument were not protected from on-coming traffic by warning signs positioned in advance of the work area. b) Fairview and Mitchell Road, middle of intersection; On or about June 5, 2011 and at times prior thereto, the employee directing traffic through the site, (the flagger) did not use hand-signaling devices, such as STOP/SLOW paddles, lights, and red flags necessary to direct drivers away from where work is being done. c) Fairview and Mitchell Road, middle of intersection; On or about June 5, 2011 and at times prior thereto, an employee directing traffic had not been instructed in the regulations concerning not only the control of on-coming traffic but also the necessity of hand-signaling devices that would direct drivers away from work areas.
