29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. (a) On or about June 11, 2012, and at times prior thereto, as the controlling employer, Roth Construction, Inc. did not ensure that the framing contractor, Ada-Can, Inc. provided fall protection for the owner working on the top plate, on the front side of the residence, placing blocks between trusses at heights of approximately 17 feet. (b) On or about June 11, 2012, and at times prior thereto, as the controlling employer, Roth Construction, Inc. did not ensure that the framing contractor, Ada-Can, Inc. provided fall protection for the carpenter, while working on the trusses, near the middle of the residence, at heights of approximately 17 feet above the concrete foundation. Note: Abatement certification is required for this item. |
