29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or before August 16th, 2022 the employer did not protect employees from injury in that framers working on the second floor of a new multifamily building were using a step ladder propped against the landing to access and exit the second story. The top rail of the ladder was slightly higher than the landing but not 3 feet above. The ladder was secured to the landing. This condition exposed employees to fall hazards of 9 feet .
