29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, nor did the employer the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. (a) On or about April 6, 2018, employees were generating visible clouds of dust containing crystalline silica while tuckpointing clinker brink masonry and grout. Engineering controls would be the use of a grinder equipped with a commercially available shroud and dust collection system. Note: Abatement certification is required for this item. |

Improper use of respiratory protection included, but was not limited to, utilizing only one of the two elastic straps on the mask.
