MEMORANDUM DECISION AND ORDER - Bunker Hills Motion to Dismiss (Dkt. 19) is GRANTED IN PART and DENIED IN PART It is GRANTED with respect to Crescents Cost Recovery under CERCLA Section 107(a), Declaratory Judgment, and Tortious Interference claims against Placer and Bunker Hill, and is also GRANTED with respect to Crescents trespass, nuisance, and negligence claims against Bunker Hill. Such claims are DISMISSED without prejudice. It is DENIED with respect to Crescents trespass, nuisance, and negligence claims against Placer. The Court MOOTS the Motion for Leave to File Second Amended Complaint. (Dkt. 47). Crescents Motion to Dismiss Counterclaim (Dkt.29) is MOOT and is therefore DENIED. Signed by Judge David C. Nye.
