The excavation did not have any protective system in place. Jerome Bowen Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1345316, citation number 2, item number 2 and was affirmed as a final order on 9/25/2019, with respect to a workplace located at 1520 W Sunnyside Road, Idaho Falls, ID 83406. |

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) On or about March 9, 2021, the supervisor (competent person) directed work in an unprotected excavation approximately 8 feet deep with nearly vertical and undercut walls. An employee installed a saddle on a water line. The excavation had evidence of cracking and fissuring walls. Heavy equipment in operation nearby added vibration of the rocky soil walls. Jerome Bowen Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1345316, citation number 1, item number 1c and was affirmed as a final order on 9/25/2019, with respect to a workplace located at 1520 W Sunnyside Road, Idaho Falls, ID 83406. |
