29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) Jobsite: On February 1, 2019 and at times prior thereto an employee worked in an area of a trench that was 6.3 feet deep. Cave-in protection was not used. The employee did not recognize or acknowledge the hazard of working in an unprotected area of the trench or take action to have the hazard minimized or controlled. b) Jobsite: On February 1, 2019 and at times prior thereto an employee worked inside a trench box without a safe means of egress. The employee did not recognize or acknowledge the hazard of not having a safe way out of the trench box or take action to correct the hazard.
