Employees jumped in as ingress and/or climbed out from the walls of the trench on the southeast corner of the trench as ingress/egress from the work location. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. a) For the trench excavated approximately 60 linear feet from north to south on this commercial site, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift. Employees were working to install a sewer line in an excavation at a depth ranging from 5.0 to 10.5 feet. Inspections were not completed for the potential cave-in hazards on the site. 29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage that could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. All defects shall be corrected before the vehicle is placed in service. These requirements also apply to equipment such as lights, reflectors, windshield wipers, defrosters, fire extinguishers, etc., where such equipment is necessary. a) On or before March 27, 2013, and at times prior thereto, the employer did not keep and maintain an operable fire extinguisher in the Case CX 80 excavator.
