The employees were exposed to fall hazards ranging from 10 feet to 19 feet to the ground below. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) South building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were installing floor joists at 10 feet above the ground with no fall protection in place. (b) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were exposed to an approximate 8-10 foot fall through a 23"x48" ladder access hole due to lack of fall protection guarding. (c) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were exposed to an approximate 30 foot fall while receiving trusses at the peak of the roof. (d) North building of the Fairview Apartment Project: On or about March 19, 2019 and at times prior to, subcontracting employees were exposed to an approximate 20 foot fall through a wall opening that had been left unguarded after materials had been received. The sub-contractor employees used the aerial lift to install drywall. They did not have a personal fall restraint system in place, potentially exposing them to a 15 to 25 foot fall. 29 CFR 1926.20(b)(2): The employer does not initiate and maintain a safety program which provides for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer: a) The controlling employer, Biltmore Company, LLC, does not perform frequent and regular safety inspections of the jobsites under their control. They do not have a system to identify, correct, and/or minimize hazards to which their employees and their sub-contractors employees are exposed to. Hazards include but are not limited to, temporary handrails not installed on stairways, temporary stair rails not installed on open sided stairways, guardrails not installed on stairway landings, personal fall protection not used when needed, exposed energized electrical panels, and housekeeping. These conditions were most recently observed at Ashville Commons 826 North Maple Grove, Boise, ID, on October 13, 2015. Biltmore Company, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 671759, citation number 2, item number 1, and was affirmed as a final order on January 7, 2013, with respect to a workplace located at 1527 West Alexandria Lane, Boise, ID 83705. Note) Pursuant to 29 C.F.R. 1903.19, the employer must submit certification AND documentation describing the steps being taken to ensure compliance, including a description of how these steps protect employees and the employees of its sub-contractors from common, obvious hazards. |
