29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., Competent person means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them). (a) Georgetown Wastewater Treatment Lagoon: On or about August 28, 2014, and at times prior thereto, a safety program was not implemented to include frequent and regular inspections by a competent person. A competent person did not inspect and identify the multiple hazards of employee(s) entering a concrete manhole (5' x 5' x 18.5') to apply Flex Seal sealant. Flex Seal contained flammable chemicals including toluene, parachlorobenzotrifluoride, acetone, heptane, isobutane, and propane. The Flex Seal was sprayed inside of a confined space that was approximately 387 cubic feet in air volume plus 75 cubic feet of water volume.
