OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under, crushed, and/or thrown from a forklift truck when not wearing a seat belt: (a) On or about May 6, 2022, and at times prior, employees operated a Toyota forklift, model 8FGU25 to unload, move, and/or load merchandise. Employees had not been formally trained to operate the forklift and/or required to wear the seatbelt. (b) On or about May 6, 2022, and at times prior, employees operated a Hyster 80 forklift to unload, move, and/or load merchandise. Employees had not been formally trained to operate the forklift and/or required to wear the seatbelt. |
